Conditions of carriage

CONDITIONS OF CONTRACT

  1. The terms used in this contract shall mean:

    • Ticket means this passenger ticket and baggage check, or this itinerary/receipt if applicable, in the case of an electronic ticket, of which these conditions and the notices form part;

    • Carriage is equivalent to transportation, carrier means all air carriers that carry or undertake to carry the passenger or his/her baggage hereunder or provide any other service incidental to such air carriage;

    • Electronic Ticket means the Itinerary/Receipt issued by or on behalf of the carrier, Electronic Coupons and, if applicable, the Boarding Document;

    • Warsaw Convention means the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed in Warsaw on October 12, 1929 or this Convention as amended by the Protocol signed in Hague on September 28, 1955, whichever may be applicable.

  2. Carriage hereunder shall be subject to rules regarding liability as set by the Warsaw Convention, unless such carriage is not an international carriage as defined by the convention. Liability of the carrier in the event of domestic carriage shall be regulated by the Air Code of the Russian Federation.

  3. To the extent not in conflict with the foregoing, carriage and other services performed by each carrier shall be subject to: (i) provisions contained in the ticket, (ii) applicable tariffs, (iii) the Carriers conditions of carriage and related regulations that are made part hereof (and are available on request at the offices of the carrier). As regards transportation between points located in the United States or Canada and any point outside thereof, tariffs shall apply which are in force in these countries.

  4. The carriers name on the ticket may be abbreviated, the full name and its abbreviation being set forth in the carriers tariffs, conditions of carriage, regulations or timetables; the carriers address shall be the airport of departure shown opposite the first abbreviation of the carriers name on the ticket. The agreed stopping places shall be the places as indicated in this ticket or shown in the carriers timetable as scheduled stopping places on the passengers route. The carriage to be performed hereunder by several successive carriers shall be regarded as a single operation.

  5. Any air carrier issuing a ticket for carriage over the route of another air carrier does so only as its agent.

  6. Any exclusion or limitation of liability of the carrier shall apply to and be for the benefit of agents, officers and representatives of the carrier and any entity whose aircraft is used by the carrier for carriage and its agents, officers and representatives.

  7. Time for making complaints to the carrier in case of international transportation. In case of damage to baggage during international transportation, a complaint shall be made in writing to the carrier forthwith after discovery of such damage by the baggage bearer and, at the latest, within seven days of receipt of the baggage and, at the latest, within fourteen days of receipt of cargo. In case of delay in the delivery of baggage, a complaint shall be made within twenty-one days of the date when the baggage or cargo was made available to the person entitled to receive the same. The said notice constitutes the basis for the preparation of a commercial act. In case of loss of baggage, a complaint shall be made to the carrier within eighteen months from the date of arrival of the aircraft at the airport of destination, from the date on which the aircraft was supposed to arrive, or from the date of cessation of air transportation.

The period of time during which a compliant shall be made to the carrier in the event of domestic air transportation. A complaint may be made to the carrier within six months in the event of domestic air transportation. Source: Articles 126, 127 of the Air Code of the Russian Federation.

The procedure for issuing, storing and tracing checked baggage is set by Chapters 12 and 13 of the Federal Aviation Rules Common Rules for Air Transportation of Passengers, Baggage and Cargo and Requirements for Servicing Passengers, Consignors and Consignees as set by Order No. 82 of the Ministry of Transport of the Russian Federation dated June 28, 2007.

  1. This ticket shall be valid for carriage for one year from the date of issue, except as otherwise provided for in this ticket, in the carriers tariffs, conditions of carriage, or related regulations.

  2. According to Article 3 of the Warsaw Convention, an air ticket, including an e-ticket, is evidence of the contract concluded between the passenger and the carrier. By purchasing a ticket, a passenger confirms that he/she agrees with the terms of the contract. If the passenger fails to use a booked seat on a flight segment, he/she shall notify the carrier about changes in the terms of the contract and his/her intention to continue their flight on subsequent segments. To do so, the passenger should contact the office where the booking was made or an Aurora office to make the required changes to his/her personal booking. If the passenger fails to perform these activities, the booking system automatically cancels the subsequent flight segments as the passenger failed to start the journey. The cancellation is performed without notifying the passenger. Source: Federal Aviation Rules, Section 2, Item 27 and Section 5, Item 75.

  3. The carrier undertakes to take all actions in its power to transport the passenger and baggage in a reasonable time. The time indicated in the schedule and other documents is not guaranteed and shall not be considered part of the present contract.

The carrier has the right to transfer its obligations under the air transportation contract in full or in any part to another person, including another carrier. The carrier is enabled to cancel or delay the flight indicated in the ticket, to change aircraft type, transportation route (including alteration or cancellation of boarding at the points indicated in the ticket) in case flight and/or aviation safety conditions require doing so or according to a demand made by governmental authorities within the limits of their competence.

Aircraft flight schedule can be changed, however the carrier undertakes to take all actions in its power to inform the passengers having executed the air transportation contract thereof by any means available.

The Carrier shall not be held liable for failure to notify the passenger about alteration of flight schedule, change of departure/destination airport, flight cancellation or alteration of any other parameters of the flight in case the passenger fails to provide his/her contact details (i.e. phone number, e-mail address, etc.) when booking corresponding air transportation or the Carrier is not able to contact the passenger using given contact details after calling each given phone number (or using all given addresses) at least once, including where contact details provided are incorrect. In the cases above mentioned the Carrier shall not be obliged to reimburse losses incurred by the passenger because of such non-notification.

The Carrier shall not be responsible for providing connection of flights where the carriage was documented by separate tickets.

  1. Passengers shall comply with government travel requirements, present exit, entry and other required documents and arrive at the airport at the time specified by the carrier or, if no time is set, early enough to complete all departure procedures.

The parties agree that the state of health of a passenger that is hazardous for the safety of the passenger himself/herself and other persons and creates a disorder or unavoidable inconvenience for other passengers shall include a medium or strong intoxication of the passenger or extremely low/high blood pressure.

If an airline representative has reasons to conclude that a passenger is in a state described above, the carrier may require the passenger to pass medical examination and the passenger must pass the proposed examination.

  1. Aurora uses personal data of passengers in booking tickets. Personal data processing is implemented using the Sabre Holding Corporation passenger service system, which data base servers are located in USA. Transboundary transfer of personal information takes place during personal data processing.

  2. If a passenger intends to cancel his/her travel, he/she personally or his/her authorized representative shall notify Aurora about the unilateral termination of the relevant contract of carriage (air ticket) as follows:

    1. in case that tickets were issued in Auroras own sales offices, branches or representative offices in Russia and abroad by way of:

      • the passenger in person or his/her authorized representative shall visit the office where the air ticket was issued and paid, present original ID documents and documents proving the representatives authority to act on behalf of the passenger, fill in an application of due form and and carry out the procedure for the return of the air ticket at the same time;

      • should visit to the office where the ticket was issued be impossible, the passenger or his/her authorized representative shall visit any Auroras own sales office, branch or representative office, present original ID documents and documents proving the representatives authority to act on behalf of the passenger, fill in an application of due form for subsequent visiting the office where the ticket was issued and paid for during the ticket validity term and for carrying out the procedure for the return of the air ticket.

    2. in case that tickets were issued via Auroras web site:

      • the passenger or his/her authorized representative shall visit the Information and Reservations Center and carry out the procedure for the return of the air ticket at the same time;
      • the passenger in person or his/her authorized representative shall visit any Auroras own sales office, branch or representative office, present ID documents and documents proving the representatives authority to act on behalf of the passenger and carry out the procedure for the return of the air ticket at the same time.
    3. in case that tickets were issued via the agent network:

      • the passenger or his/her authorized representative shall visit the office where the air ticket was issued and carry out the procedure for the return of the air ticket at the same time;
      • should visit to the office where the ticket was issued be impossible, the passenger or his/her authorized representative shall visit any Auroras own sales office, branch or representative office, present original ID documents and documents proving the representatives authority to act on behalf of the passenger, fill in an application of due form for subsequent visiting the office where the ticket was issued and paid for during the ticket validity term and for carrying out the procedure for the return of the air ticket.
    4. the written passengers or his/her authorized representatives notice shall be delivered by registered mail to Aurora with a completed application of a standard pattern bearing the passengers (authorized representatives) notarized signature and copies of relevant ID documents enclosed. The time of declaration of ticket cancellation shall be the date and time when the complete set of the required documents is received by Aurora. The set of documents received shall be transferred to the relevant subdivision of the Auroras Sale Department for further cancellation of the reservation, preparation and dispatch of instructions to the relevant agency, Auroras own sales office, branch or representative office with regard to the refund of the amount due for unused ticket to be paid to the passenger or his/her authorized representative at the office where the ticket was issued and paid for.

      In case of air carriage paid for by any legal entity regardless of the sales channel, the original power of attorney certified by signatures of the Chief Accountant and General Director (or any other authorized persons) and bearing the corporate seal of the entity shall be presented along with the passengers ticket cancellation application. Should the passenger (an authorized representative) be unable to come in person to obtain the refund of the amount due for unused ticket to the office were the ticket was sold, the issue of the refund shall be resolved by Aurora using the complaint procedure.

  3. No agent, officer or representative of the carrier has the authority to alter, modify or waive any provision of this contract.
